1. What this site is

Canard Classifieds is a free listing board where people may post aircraft, aircraft projects, and related equipment for sale, and where others may browse those listings and contact sellers. We charge no fee and take no commission on any sale. We are not a broker, dealer, escrow agent, or party to any transaction between a buyer and a seller. Any sale arranged through this site is a private transaction solely between the buyer and the seller.

2. No verification of listings

We do not inspect, verify, or authenticate any aircraft, aircraft project, or equipment listed on this site. We do not confirm airworthiness, ownership, registration status, build quality, log accuracy, damage history, or the accuracy of any statement, photo, or description a seller submits. Buyers are solely responsible for conducting their own due diligence before any purchase, including but not limited to: a pre-purchase inspection by a qualified mechanic or A&P, review of maintenance and build logs, a title/lien search, and confirmation of registration and airworthiness status with the FAA or the applicable civil aviation authority for the aircraft's country of registration.

3. Ownership of listing content

Sellers retain ownership of the text, photographs, and other content they submit. By posting a listing, a seller grants us a non-exclusive license to display that content on this site for the purpose of operating the listing board. We do not claim ownership of any listing content, and a seller may request removal of their listing and its content at any time through their listing management link.

4. No warranty

This site and all content on it are provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.

5. Limitation of liability

To the fullest extent permitted by law, Canard Classifieds and its operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, death, property damage, or financial loss, arising out of or in any way connected to: (a) any transaction or attempted transaction between a buyer and a seller; (b) any aircraft, project, or equipment listed on the site; (c) reliance on any information, description, or photo posted by a seller; or (d) use of or inability to use the site. This limitation applies regardless of the legal theory of liability and even if we have been advised of the possibility of such damages.

6. Buyer and seller responsibility

Users of this site are solely responsible for their own conduct and for any agreement they enter into with another user. We strongly encourage both buyers and sellers to use a written bill of sale or purchase agreement for any transaction. The Experimental Aircraft Association (EAA) publishes a sample purchase and sale agreement for homebuilt and experimental aircraft that may be a useful starting point; EAA membership is required to access it. Nothing on this site is legal advice, and we recommend both parties consult their own attorney before completing a sale, particularly for higher-value transactions.

7. Prohibited conduct

Users may not: post a listing for an aircraft, project, or equipment they do not own or have authority to sell; submit false, misleading, or fraudulent information; use the site to harass, spam, or solicit users outside the purpose of a genuine buying or selling inquiry; or attempt to circumvent the site's security or rate-limiting measures. We may remove any listing or restrict access to the site at our discretion, including in response to reports of fraud or abuse.

8. Listing duration

Listings are active for 90 days from posting or last renewal, after which they expire and are removed from public browsing. Sellers may renew an active or expired listing at any time through their listing management link.

9. Copyright

If you believe content on this site infringes your copyright, contact us at [email protected] with: a description of the copyrighted work, the location of the allegedly infringing material, your contact information, and a statement that you have a good-faith belief the use is unauthorized. We will review and remove infringing material as appropriate.

10. Changes to these terms

We may update these terms from time to time. Continued use of the site after a change is posted constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions, to the extent enforceable given users may access this site from other jurisdictions.
